TERMS OF SERVICE

These Terms of Service govern the online coaching services provided by Maxime SAUVET ("the Coach", "we", "us") to you ("the Client", "you"). By paying your first invoice, you confirm that you have read and accepted these Terms.

1. Who we are

The Coach holds a French professional sports educator card (carte professionnelle d'éducateur sportif) and IRONMAN University and NASM certifications.

2. Eligibility

Our services are available to adults aged 18 and over who are legally able to enter into a contract.

3. Our services

We offer online running and marathon coaching, online triathlon and IRONMAN coaching, and the coaching part of Race + Travel. Depending on the plan you choose, coaching includes a personalized training plan on TrainingPeaks, daily feedback on the sessions you upload, messages with the Coach, regular video calls, and nutrition and race-day strategy. The exact content of each plan is the one described on the website when you start.

All coaching is delivered remotely. The Coach commits to doing everything reasonably possible to help you reach your goal (an obligation of means), but cannot guarantee a specific result, time or ranking.

The travel services of Race + Travel (flights, accommodation, transfers, restaurants, activities and race entries) are designed and sold by our partner travel planner, Charline (The French Travel Planner), under her own terms and conditions. They are not covered by these Terms.

4. Getting started

Coaching starts after a free consultation and the payment of your first invoice. You agree to provide accurate and complete information about your health, training history, goals and availability, and to keep it up to date.

5. Prices and payment

Prices are shown on the website in US dollars per month. Race + Travel is priced on quote. Each month of coaching is invoiced separately: you receive an invoice by email with a secure payment link, payable by card or bank transfer before the start of the month. Any currency conversion or foreign transaction fees charged by your bank are your responsibility.

We may change our prices. Any change is announced at least 30 days in advance and only applies to future invoices.

6. No commitment, no automatic renewal

There is no minimum commitment and no automatic renewal. Nothing is ever charged to your card without your action: you only pay the invoices you choose to pay.

You can stop your coaching at any time by telling the Coach by email or message before your next billing date. No further invoice will be issued. A month that has started and been paid is not refunded, except if the Coach fails to provide the service, in which case unused days are refunded on a pro rata basis.

The Coach may end the coaching relationship with 15 days' notice, or immediately in case of non-payment or serious breach of these Terms. Unpaid invoices may lead to the suspension of the service.

7. Right of withdrawal

Where a legal right of withdrawal applies to you (for example if you are a consumer in the European Union), you ask for coaching to start immediately after payment. If you withdraw within 14 days, you will pay only for the part of the service already provided. You lose this right once the service has been fully provided.

8. Health and safety

Endurance sports carry inherent risks, including injury. Before starting, you confirm that you are fit to train for your goal and we strongly recommend that you consult a physician, especially if you have a known medical condition or any doubt about your health.

You agree to inform the Coach without delay of any injury, illness, pain or change in your health, and to stop training and seek medical advice if you feel unwell. The Coach does not provide medical diagnosis or treatment, and the coaching does not replace medical care.

9. Liability

You remain responsible for how you apply the training plan and the Coach's advice. To the extent permitted by law, the Coach is not liable for injuries, damage or health problems resulting from a misinterpretation or incorrect application of the advice, from not following safety instructions, or from health information you did not disclose.

To the extent permitted by law, the Coach's total liability is limited to the amount you paid for the coaching during the three months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Intellectual property

Training plans, documents and all content provided as part of the coaching remain the exclusive property of the Coach. They are for your personal use only and may not be copied, shared, resold or published without the Coach's prior written consent.

11. Image rights

The Coach will only use your photos, videos or testimonials for promotion with your separate written consent, which you can withdraw at any time.

12. Personal data

Your personal information is processed as described in our Privacy Policy.

13. Governing law and disputes

These Terms are governed by French law, without depriving you of the protection of the mandatory consumer laws of your country or state of residence. In case of a dispute, please contact the Coach first so we can find an amicable solution. If we cannot agree, you may use a consumer mediation service, and failing that, the dispute will be brought before the competent courts.

14. Changes to these Terms

We may update these Terms. The version that applies to you is the one in force when you pay your invoice. The current version is always available on this page.
